The Government of India notified the National Highways Fee (Determination of Rates and Collection) (Second Amendment) Rules, 2026, according to a PIB release issued on March 18, 2026. The revised rules came into effect from March 17, 2026.


Definition of Unpaid Toll Introduced

The amendment defines “unpaid user fee” as toll charges applicable to a vehicle whose movement has been recorded through Electronic Toll Collection (ETC) systems, but where payment has not been received.


E-Notice System for Recovery

A structured recovery process has been introduced under Rule 14. Vehicle owners will receive electronic notices containing details such as vehicle number, date and location of toll passage, and payable amount. These notices may be sent through SMS, email, mobile applications, or made available on an online portal.


Penalty Structure and Payment Window

If a toll remains unpaid, the payable amount will be twice the original fee. However, if the payment is made within 72 hours of receiving the e-notice, only the original toll amount will be charged.


Integration with VAHAN Database

The system will be linked with the VAHAN vehicle registration database to identify vehicles and track pending dues. If unpaid tolls remain unsettled for more than 15 days, and no dispute is filed, the amount will be recorded in the system. This may lead to restrictions on certain vehicle-related services until payment is made.


Grievance Redressal Mechanism

Vehicle owners can submit complaints or disputes through the designated portal within 72 hours of receiving an e-notice. Authorities are required to resolve such cases within five days. If no decision is made within this period, the claim for unpaid toll will be cancelled.


Focus on Digital Enforcement

The amendment formalises a system for digital toll enforcement and recovery, particularly in the context of barrier-free toll collection systems being implemented on National Highways.
